Terms of Use and Sale

These Terms of Use and Sale govern the use of the cleansmart.gr online store and purchases made through it. Please read them before placing an order.

The specific policies concerning payments, delivery, returns, personal data and cookies form a supplementary part of these Terms. Mandatory provisions of applicable law shall prevail in all cases.

2. Scope and acceptance

These Terms apply to browsing cleansmart.gr, creating and using an account, and orders placed through the online store. Use of the website is subject to acceptance of the terms governing its operation. Before completing an order, the customer is asked to read and accept the terms governing the transaction.

A “consumer” is a natural person acting for purposes outside their trade, business, craft or profession. Provisions specifically applicable to consumers, such as the statutory right of withdrawal, do not apply to purchases made in the course of a professional or business activity.

In business-to-business transactions, any specific terms contained in a written quotation or separate agreement shall prevail over these Terms solely in relation to that particular transaction. No provision limits any rights granted on a mandatory basis by law.

3. Use of the website and customer accounts

Users must use the website lawfully, provide accurate and complete information, and refrain from any action that may affect its security, availability or proper operation.

A person making a purchase must have the legal capacity to enter into the transaction. Anyone acting on behalf of a business or another person represents that they have the necessary authority to do so.

The account holder is responsible for keeping their login credentials confidential and must promptly notify CleanSmart if they become aware of any unauthorised use. CleanSmart may temporarily suspend access to an account where this is necessary for security purposes or to investigate unlawful or abusive use.

4. Products, information, prices and availability

CleanSmart makes reasonable efforts to ensure that product descriptions, technical specifications, images and prices are accurate and up to date. Minor differences in the display of colours may occur depending on the user’s screen or device. The essential characteristics of each product are presented on its product page.

The displayed prices include the applicable VAT unless expressly stated otherwise. The total price, including delivery costs and any other applicable charges, is displayed before the order is finally submitted.

Availability information is updated regularly but may change before the order has been checked, particularly where simultaneous sales take place through different channels. If a product is unavailable, the customer will be informed without undue delay and any amount already paid for that product will be refunded.

If an obvious technical or typographical error is identified in a price or an essential product characteristic, CleanSmart will inform the customer before fulfilling the order. The customer may confirm the purchase using the correct information or cancel without charge and receive a refund of any amount already paid.

5. Placing and confirming an order

Before submitting an order, the customer can review and correct the products, quantities, billing and delivery details, payment method and delivery method. The final order submission creates an obligation to pay the total amount displayed.

After submission, an electronic acknowledgement is sent confirming that the order has been received by the system, together with its main details. The automated acknowledgement of receipt does not, by itself, constitute an unconditional confirmation of availability. Acceptance and fulfilment of the order are communicated through a subsequent update concerning processing, dispatch or readiness for collection.

CleanSmart may contact the customer where clarification of information, confirmation of payment or delivery arrangements are required. The customer is responsible for ensuring that the email address and telephone number provided are correct.

If the order cannot be fulfilled due to unavailability, inability to confirm payment, incomplete information preventing fulfilment or an obvious error, the customer will be informed and any amount paid will be refunded without undue delay.

6. Payment methods

The available payment methods, their conditions and any related charges are described in detail on the Payment Methods page and are displayed before the order is completed.

For payment by bank transfer, order processing begins once the funds have been credited to the company’s account. Any charges imposed by the customer’s financial institution or an intermediary provider are not charges levied by CleanSmart.

Card payments are processed by the payment service provider engaged by CleanSmart from time to time, in accordance with that provider’s security measures and terms.

7. Dispatch, delivery and collection

The available delivery and collection methods, geographical restrictions and the method used to calculate delivery charges are described on the Delivery Methods page. The available options and exact cost are displayed before the order is submitted.

The stated delivery times are estimates unless a specific deadline has been expressly agreed. Unless otherwise agreed, products will be delivered without undue delay and no later than thirty (30) calendar days after the contract has been concluded.

If a delay occurs due to circumstances that could not reasonably have been foreseen or prevented, CleanSmart will inform the customer. Such notification does not limit any rights available under applicable law in the event of non-delivery.

For consumer purchases, the risk of loss of or damage to the products passes to the consumer when the consumer, or a third party designated by the consumer, acquires physical possession of them, except where the consumer has chosen a carrier that was not offered by CleanSmart.

8. Cancellation, withdrawal and returns

The customer may request cancellation before the order has been dispatched or prepared by contacting +30 210 6646 518 or info@cleansmart.gr. CleanSmart will make reasonable efforts to stop fulfilment. If the order has already been dispatched, the withdrawal and return rules apply.

A consumer making a distance purchase has the right to withdraw without giving any reason within fourteen (14) calendar days, subject to the statutory exceptions. The applicable time limits, procedure, return costs, refunds, exceptions and model withdrawal form are described in detail in the Returns & Withdrawal Policy, which forms an integral part of these Terms.

The consumer right of withdrawal does not apply to purchases made for business or professional purposes. Any return of a business purchase due to a change of mind requires CleanSmart’s prior written agreement.

9. Legal liability for lack of conformity and commercial guarantees

CleanSmart, as the seller, bears legal responsibility where a product is defective at the time of delivery or does not conform to the agreed or objective requirements. For consumer purchases, the seller’s two-year statutory liability applies in accordance with applicable law.

In the event of a lack of conformity, the buyer has the remedies provided by law, including bringing the product into conformity through repair or replacement and, where the statutory conditions are met, a reduction in price or termination of the contract. The product must be brought into conformity free of charge, within a reasonable time and without significant inconvenience to the consumer.

Any commercial guarantee or extended warranty offered by a manufacturer, producer or seller is additional to the seller’s statutory liability and is governed by its own specific terms. It does not limit or replace the buyer’s statutory rights. Where product registration or another action is required to activate a commercial warranty extension, this is stated on the product page or in the relevant programme terms.

For faster handling of a request for technical inspection or warranty service, customers are advised to provide the receipt or other proof of purchase and the order number.

10. Personal data and cookies

The processing of personal data carried out when browsing the website, creating an account, placing an order and communicating with CleanSmart is described in the Privacy Policy.

Cookie categories, purposes, retention periods and management options are described in the Cookie Policy. Non-essential cookies are enabled in accordance with the choices made by the user through the consent management mechanism.

12. Website operation, external links and liability

CleanSmart takes reasonable technical and organisational measures to support the secure and proper operation of the website. Temporary interruptions due to maintenance, technical problems, network failures or circumstances beyond its reasonable control cannot be entirely excluded. Where possible, operation will be restored without undue delay.

The website may contain links to websites operated by manufacturers, payment providers, carriers or other third parties. CleanSmart does not control the content or operation of these independent websites, and their use is governed by the terms and policies of the respective operators.

Nothing in these Terms excludes or limits CleanSmart’s liability or any customer right where such exclusion or limitation is prohibited by a mandatory provision of law.

13. Complaints and alternative dispute resolution

For a complaint or dispute concerning an order, product or service, you may first contact CleanSmart at customerservice@cleansmart.gr or +30 210 6646 518, quoting the order number and relevant details where available.

A consumer who has been unable to resolve a dispute may, where the applicable jurisdictional requirements are met, submit a complaint to the independent authority Consumer Ombudsman or contact another certified Alternative Dispute Resolution body.

Use of an alternative dispute resolution procedure does not deprive either party of the right to seek judicial redress.

14. Governing law, amendments and validity

These Terms and transactions made through cleansmart.gr are governed by Greek law, without prejudice to any mandatory provisions protecting the consumer. Jurisdiction lies with the courts designated by the applicable rules of civil procedure. These Terms do not limit a consumer’s right to bring proceedings before a court having jurisdiction under mandatory provisions of law.

CleanSmart may update these Terms for future use of the website and future transactions, particularly due to changes in legislation, services or the operation of the online store. Amendments do not apply retrospectively to orders that have already been accepted.

If any provision is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent that they can operate independently. In the event of a conflict with a mandatory provision of law, the mandatory provision shall prevail.
